“The Company”, “We” and related terms means Made of Metal Ltd trading as alloywheelworld (Made Of Metal LTD, PO Box 177, Benfleet, Essex. Company No. 5463002. VAT No. GB 888 2441 83) and “The Purchaser”, “you” and related terms means the party ordering goods from the Company and named on the relevant sales invoice. 1 –The Contract::: Other words and phrases are defined below. Where a word or phrase is not defined, it has its ordinary meaning.
1 - The Contract:
The Company is a supplier of specialist motor parts via its online shop at www.alloywheelworld.co.uk (the shop). By placing an order with the Company the Purchaser agrees to enter into a legally binding contract with the Company.
2 - Orders:
Placement of an order via the shop is an offer to purchase; The automatic email confirmation of the order is not an acceptance of the offer. It is simply confirmation that the Company has received the order and a chance for the Purchaser to check that all details have been entered correctly; The offer is accepted when the Company receives payment in respect of the relevant sales invoice. At this point the contract becomes legally binding upon both parties. Except where goods are specially ordered or modified for the Purchaser in accordance with the Purchaser's instructions (special orders), the Purchaser has the right to cancel the order at any time up to seven days after the goods have been delivered, upon written notice to the Company (this may be by letter, fax or email) (see Clause 13, below). In this event the Company will provide a full refund (Distance Selling Regs).

Orders are subject to availability of the relevant goods. If goods are paid for and later prove to be unavailable the Company will refund the Purchaser in full. The Company cannot accept any liability for any losses resulting from the unavailability of goods.
3 - PAYMENT:
Goods will only be dispatched on receipt of payment in full. Payment can be made by credit/debit card, cheque or bank transfer.
3a - PAYMENT SECURITY:
Orders placed via the shop are encrypted using a 'Secure Socket Layer' session. SSL is an industry standard and is one of the best ways to ensure Internet messages are not intercepted. This is handled in a different area of the Company's server. A little gold/yellow padlock appears on the screen. This is an assurance to Purchasers that any information they pass to us is securely encrypted as soon as it is sent.
4 - PRICES:
The Company endeavours to keep all prices and information on this web site up to date. However, prices and information from the Company's suppliers may change at any time. The Company therefore reserves the right to alter specifications and prices on the website at any time. In the event that any details of any item ordered through the shop change, the Company will endeavour to hold to the price shown at the time of ordering. However, in cases of substantial increase the Purchaser will be contacted to agree a new price before payment is accepted. If the Purchaser does not agree to any changes the Company reserves the right to withdraw from the transaction. If the Purchaser cannot be contacted, the Company will treat the order as cancelled. If a mistake is made in email or phone quotations the Company reserves the right to correct these. The Purchaser will be informed of any corrections before the Company proceeds with the order and will have the right not to proceed with the order. The Company is not taken to be bound to any price quoted until the Purchaser has received the invoice.
5 - VAT:
Prices shown on the website include VAT. If for any reason VAT has not been included it is clearly indicated. All price quotations by phone or email also include VAT unless otherwise stated.
6 - WARRANTIES:
All warrantees in respect of products sold via the shop are provided entirely by the manufacturers and/or UK importers and are subject to their terms and conditions. If the Purchaser wishes to pursue a warranty claim the Company will act on the Purchaser's behalf. All claims are treated as urgent. Goods may need to be returned either directly to the manufacturer or to the Company. Please see our returns policy (Clause 12 below) for full details of how to return goods. Goods being returned under warranty must be accompanied by a valid proof of purchase and must be returned with carriage paid. Any compensation for breach of warrantee is payable by the provider of the warrantee.

Parts modified or adapted by the purchaser will not be warranted by the manufacturer
Please note also:
Unless otherwise stated, goods modified for the Purchase prior to delivery, such as tyres being fitted to wheels, are warranted.
7 - Limitations and Exclusions: In addition to any other limitations or exclusions of liability contained in these terms, the Company can accept no liability whatsoever for:
• Breach of warrantee by the Purchase or any other person.
• Any labour or associated costs involved in a warranty claim.
• Any failures which occur after the product has been modified and which are the result of that modification by the Purchaser or otherwise.
• Any failure by the Purchaser to have the relevant vehicle inspected and to obtain relevant independent professional advice prior to purchase.
• Use of any part for any purpose other than that stated in the description on the Company's website or generally accepted as a normal purpose for that part.
• Any failure by the Company to deliver on a specified date where the failure is beyond its reasonable control.
• Any attempt by the Purchaser to fit or have fitted an incorrect part by modifying it or otherwise. This applies where the Purchaser knows or ought reasonably to know that the part supplied has been incorrectly ordered or supplied.

Any advice given by the Company by telephone or email is opinion only, based upon information supplied by the Purchaser or any other person.

8 - Incompatible Goods:
Goods may not be compatible with a vehicle which has been modified in any way. In these cases the Company cannot accept the incompatible goods back into stock.
9 - Fitting:
Fitting is the sole responsibility of the Purchaser. In the rare event of an item proving defective the Company will act on the customer's behalf to obtain compensation for fitting charges from the manufacturer/UK importer (see Clause 6, Warrantees, above).
10 - Deliveries:
The Company endeavours to deliver on the date given. However, delivery times are approximate only. Where delivery times are quoted they should be construed as “working days” - any day excluding Saturday, Sunday and public holidays. If any delays are known to the Company the Purchaser will be informed immediately and a new delivery date offered. The Purchaser is not obliged to agree to a new delivery date (Distance Selling Regs) and may cancel the order at this point. Except in the case of special orders, the Company will refund the Purchaser in full.
11 - SHORTAGES & DAMAGE IN TRANSIT:
Once the Purchaser or anyone receiving the goods on their behalf has signed for the delivery the Purchaser is deemed to have accepted that the goods are undamaged and that everything on the invoice/packing slip has been received. If it is not possible for the goods to be checked prior to signing, the signature must be signed for as “unchecked”. If this is not done the Company may not be able to make a claim from the couriers on the Purchaser's behalf for any shortage or damage occurring in transit.
Please note:
The Company can accept no liability whatsoever for any loss or damage to goods in transit. The goods become the Purchaser's property when they leave the Company's or supplier's premises. Purchasers are asked to notify the Company immediately of any problems with the order. If it is likely that the Purchaser will not be the person signing for the goods (such as deliveries to a work address) it is the Purchaser's responsibility to ensure that the person signing checks the goods or signs for them as unchecked.
12 - Returns Policy:
12.1 - General:
Except in relation to special orders, if you wish to exercise your right to cancel within seven days of receiving the goods, please notify us in writing (see Clause 2, above). Returns must be accompanied by the following information: Purchaser's name daytime telephone number order number > The reason for the return and a copy of the original receipt for payment for the goods.
12.2 - How to Return Goods:
It is recommended that goods are returned by the Purchaser, but if this is not possible (for example, if goods are too heavy and/or bulky) Purchasers may wish to use our Courier Service to collect the package from their home or business address.
Please note:
Use of this service carries a standard administration charge of £10 in addition to the return delivery charge. All parcel(s) must be securely wrapped.
Please note:
The Company can accept no liability whatsoever for any loss or damage of goods in transit. Purchasers are advised to take up any claims for loss or damage of returned goods directly with the couriers.
12.3 - Payment for Return Carriage:
(I) Incorrectly supplied or damaged goods:
The Company will refund the cost of the return provided the Purchaser supplies a receipt for the costs.
(II) Unwanted goods:
Except in relation to special orders, where the Purchaser wishes to exercise their right to cancel, the Purchaser is responsible for the cost of the return. Where goods can be returned directly to the Company there will usually be no additional handling fee. If it is necessary for us to charge a handling fee the Purchaser will be notified in advance and the fee explained. In some cases it may be necessary to return the goods directly to one of our suppliers which will attract a handling fee. (typically 10-15%). This fee will be charged to you.
(III) Unwanted special orders:
Unwanted Special Order Goods The Company reserves the right to refuse to accept back unwanted special orders. However, it may be possible in some cases to accept returns if we can sell them within a reasonable time.
(IV) Warrantee Claims:
As explained in Clause 7 (above) all warranty claims need to be returned carriage paid. In some cases the manufacturer may agree prior to the return to pay the carriage in the case of a successful claim.
Please Note:
The majority of the manufacturers/importers in our market do not credit anybody with warranty carriage costs, but if they do, we will pass the credit onto you.
(V) Incorrect Parts:
In the unlikely event that a part has been supplied incorrectly where the defect is due to the Company arrangements will be made to send the correct part as quickly as possible. Alternatively the Purchaser may return the part to us for an immediate refund.
Please note:
The incorrectly supplied part must be returned before a replacement can be sent. If the part is required before return of the incorrect item payment will be required for the replacement. This payment will be refunded to you immediately on return of the incorrect part. This is standard practice in the car parts mail order industry to prevent fraudulent purchases being made.
(VI) Damaged Goods: (See Clause 11, above).
All damaged goods must be reported to us on the day of receipt in order for us to claim against the courier. These rules are imposed on us by the courier company. The Company will endeavour to arrange for goods to be replaced immediately upon the return of the damaged goods.

14 - Statutory Rights:
Nothing in these terms attempts to limit or exclude your statutory rights.
15 - Governing Law and Jurisdiction:
These terms are governed by English law and are subject to the exclusive jurisdiction of the English courts.
16 - Severance:
If any part of these terms is found by an English court to be illegal or unenforceable it shall be severed and the remainder of the agreement shall continue as though the illegal or unenforceable part had never been included.
17 - Purchasers' Information:
The Company takes all reasonable steps to keep Purchasers' information secure and confidential. No information about any Purchaser is shared with any third party without the Purchaser's permission unless required by to fulfill the agreement (for instance where the Company is acting on the Purchaser's behalf in respect of a warrantee) or where the information is required to be shared by law.
19 - Waiver:
No omission by the Company to enforce any right under these terms is to be deemed a waiver of that right.
